Give the Navajo water, all of it?

 RantWoman is a bit of a "throw things at the radio" news junkie.


RantWoman is not a lawyer. In fact, RantWoman has decided several times not to go to law school.


However, as an NPR addict and idiosyncratic interpreter of judicial decisions, RantWoman wants to offer the following comment on the #Scotus decision ruling that the federal government is under no obligation to help the Navajo nation STUDY how much water they are entitled to UNDER TERMS OF A TREATY from the Colorado River system.


RantWoman's comment: Once again RantWoman is a terrible alumna from the undergraduate instutition counting 3 sitting Supreme Court Justices among its graduates. YES, Geographic Diversity among judges MATTERS. Justice Gorsuch from CO, right near the Navaho nation. He wrote the dissenting opinion noting the Kafkaesque comparison between the Navajo nation's efforts to be reasonable and someone standing in line after line at the DMV only to be told over and over that they are in the wrong line.


The Navajo are asking for government help to STUDY the meaning of a treaty promising them sufficient water for their needs. If the court does not think it has the authority to compel other branches to act in support of an existing treaty, it is probably a good thing RantWoman is not the attorney for the Navaho nation: RantWoman would be sorely tempted to advise: well if the federal government refuses to help, file a lawsuit claiming title to all of the Colorado River. Probably a fund to find attorneys and consultants to make a more nuanced claim would be a better idea, but RantWoman is tempted.
